A federal judge in New York is considering whether to grant a temporary restraining order against two health plans that offer to help men who cannot afford to pay for erectile dysfunction medication.
The federal judge in Manhattan ruled Thursday that the state-licensed health plans could be held jointly liable as an insurer to reimburse patients for erectile dysfunction medications.
The health plans were founded in the early 1990s and began to provide a free version of Viagra to men who had erectile dysfunction or erectile dysfunction that did not have an active medical cause, such as a heart problem, blood vessel problems or diabetes.
The state-licensed plans also provided patients with a $10 co-payment for Viagra and $3 a month for a monthly supply of the erectile dysfunction medication.
In April, health plans officials in Connecticut and Florida began to restrict the availability of Viagra and the erectile dysfunction medication because they found that the plan would not provide any benefits. The state plans are currently offering a free version of the medication for up to 30 days. The plan also offered patients a 90-day supply to help pay for the medication. But state officials are not required to pay for the medication itself.
The state has not yet decided whether it will appeal the decision, which was announced by Connecticut Supreme Court Justice Michael Sebelius. But it was approved by the court Thursday, a day after the state denied the state’s petition.
The states have argued that the availability of the erectile dysfunction medication could increase the risk of heart attacks and strokes.
“We’ve seen a lot of people using these erectile dysfunction drugs and the number of men that go through the emergency room are increasing,” said James B. Leopold, the health plan manager who oversees the state’s health programs. “That’s not the reason we need to support them.”
Lawyers for the state are calling for the state’s lawsuit to be taken up with the federal court, which is expected to take up the issue in late summer.
The lawsuit was filed on behalf of a patient who was unable to afford Viagra and was in a state-licensed plan for erectile dysfunction.
“We are going to take up the issue,” said B. C. attorney Richard Gerengo. “The federal government should be able to do what it can to help patients with their health problems.”
While the federal judge is in New York, other states and the federal government have taken up the issue.
In January, New York Attorney General Eric Schneiderman sent a letter to the state’s Medicaid program informing them that if the state was unable to provide the medication, it could pay for the medication itself.
In April, the states of California and Florida joined in a lawsuit in which federal officials alleged that Medicaid patients were being provided an unfair advantage by the state’s health plans because it provided the medication for less than they could have paid for the medication.
The lawsuits are based on allegations that the states were forced to provide Viagra because they failed to provide patients with the erectile dysfunction medication for an extended period.
The federal lawsuit was filed in September by former state Sen. Charlie Collins, R-Wail, who said he would be “very concerned” if the state’s health plans were permitted to reimburse patients for erectile dysfunction medication.
Collins, who has not been named, said the state’s plans will have to find another way to cover the cost of the medication.
“The health plan is going to have to find another way for patients,” Collins said. “We have no option but to pay for it.”
The state’s plan is owned by the state of Massachusetts. Collins said it would have to pay for the erectile dysfunction medication itself in Massachusetts.
The states have argued that the state plan’s ability to provide Viagra for patients in Massachusetts would be limited.
“If the state is unable to pay for the medication, that would be a big problem,” Collins said. “We need a plan that covers all the patients and not just the state’s plan.”
The states are not required to pay for the medication itself because it has been prescribed for less than they can afford to pay for it. Massachusetts is a state that has not received a Supreme Court decision on the issue.
